Sending a notice
A notice has to contain all of these. Without them we may not be able to act on it.
- Your signature, written or typed.
- The work you say was copied. If there are several, a list that represents them.
- What on the service you say copies it, and where it is, with enough detail for us to find it. Most work here is private to an organization and has no public address: a link if you have one, otherwise the organization, the project and a description.
- How to reach you: an address, a phone number and an email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
- A statement that what the notice says is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
What we do with a notice
When a notice is complete, we take what it names out of use promptly: it can no longer be opened, played, downloaded or sent to a model, and neither can identical copies of it that we know we hold. We tell the person who put it there, and send them the notice. We keep a record of the notice and of what we did.
Sending a notice or a counter-notice that you know to be false can make you liable for damages, including costs and lawyers' fees.
Sending a counter-notice
If your work was removed and you believe that was a mistake, send the agent a counter-notice with all of these:
- Your signature, written or typed.
- What was removed, and where it was before it was removed.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or because it was wrongly identified.
- Your name, address and phone number.
- A statement that you accept the jurisdiction of the federal district court for the district of your address (or, if you are outside the United States, any district where Story Atlas LLC may be found), and that you will accept service of process from the person who sent the notice or their agent.
After a counter-notice
We send a copy of the counter-notice to the person who complained. We put the work back no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless that person tells us first that they have gone to court to stop the use.
Repeat infringers
We close the accounts of people who infringe repeatedly, in appropriate circumstances. Each removal that stands is kept on the account's record, and each decision to close an account is made by a person and written down with its reason.
